Go Fund It Now platform agreement

Effective date: July 2, 2026

1. Acceptance of terms

By creating an account or accessing the Go Fund It Now ("GFIN") platform, you agree to be bound by these Terms & Conditions, the Privacy Policy, the Data Use & Privacy Disclosure, and the Responsible AI & Platform Use Disclosure. These terms form a legally binding agreement between you (and the organization you represent) and Go Fund It Now, LLC. If you do not agree, do not access or use the platform. Continued use after a materially updated version takes effect constitutes acceptance of the updated terms for future use.

2. Description of service

GFIN is an AI-assisted funding pursuit platform for nonprofit organizations, government contractors, and enterprises. It provides opportunity discovery, eligibility and fit analysis, requirements extraction, proposal drafting, collaboration workspaces, and submission preparation tools. AI-related limitations, responsibilities, and disclosures are described in the Responsible AI & Platform Use Disclosure, which is part of these terms.

3. User accounts and responsibilities

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to provide accurate, current, and complete registration information and to keep it updated. You may not share credentials with unauthorized individuals or use another person's account without permission. Notify GFIN promptly of any suspected unauthorized use of your account.

4. Customer content and intellectual property

All platform technology, design, features, models, and underlying intellectual property are owned by Go Fund It Now, LLC and protected by applicable law. You retain full ownership of the content, data, documents, and materials you upload or create through the platform.

By using GFIN you grant us a limited, non-exclusive license to host, process, index, and display your content solely to deliver the services you request, subject to the access and AI-training restrictions in the Privacy Policy. You represent that you have the rights necessary to upload the content you submit and that your content does not infringe third-party rights.

5. Disclaimers and limitation of liability

The platform is provided on an "as is" and "as available" basis. GFIN does not guarantee eligibility, compliance, funding, award, or any outcome, as further described in the Responsible AI & Platform Use Disclosure.

To the maximum extent permitted by applicable law, Go Fund It Now, LLC is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities arising from use of the platform. Our total liability for any claim under these terms will not exceed the fees you paid to GFIN in the twelve months preceding the claim, regardless of the theory of liability.

6. Termination

Either party may terminate this agreement at any time with written notice. You may close your account through platform settings or by contacting support. On termination, your access ceases; we will make your uploaded data available for export for thirty (30) days, after which deletion and retention follow the Privacy Policy. GFIN may suspend or terminate accounts that violate these terms without prior notice.

7. Governing law

These Terms & Conditions are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

8. Dispute resolution and arbitration

All disputes arising out of or in connection with the present contract shall be finally settled under the Rules of Arbitration of the International Chamber of Commerce by one or more arbitrators appointed in accordance with the said Rules.

Unless the parties agree otherwise, the number of arbitrators shall be one, the seat of arbitration shall be Wilmington, Delaware, United States, and the language of the arbitration shall be English. This section does not prevent either party from seeking temporary injunctive relief in a court of competent jurisdiction to protect intellectual property or confidential information, and it does not waive any right you may have to bring an individual claim in small claims court where that right cannot be waived by agreement.

These terms incorporate the Privacy Policy, Data Use & Privacy Disclosure, and Responsible AI & Platform Use Disclosure. Our Accessibility Statement is published separately and is not part of this agreement.
